Resolution No. 463
Stating Policy of Bolinas Community Public Utility District Concerning Drug Use in the Workplace.

    WHEREAS, Bolinas Community Public Utility District is committed to maintaining a drug-free workplace; and

    WHEREAS, drug and alcohol use can jeopardize safety in the workplace, impairing judgment and response times, causing mishandling of machinery, and leading to accidents; and

    WHEREAS, driving under the influence of any substance, including many prescribed medications, can result in accidents caused by impaired judgment and reactions; now

     THEREFORE, BE IT RESOLVED by the Board of Directors of the Bolinas Community Public Utility District as follows:

The consumption of alcohol while engaged in the execution of ones duties is forbidden and the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance as defined in Schedules I through V of the Controlled Substances Act (21 U.S. C. 812) and as further defined by regulation (21 CFR 1308.11 through 1308.15) is prohibited in the workplace.

All employees are required, as a condition of employment by the District, to abide by the terms of the attached statement, and, in addition, to notify the District in writing of any conviction for a violation of a criminal drug statute occurring in the workplace, no later than five calendar days after such a conviction.

The minimum penalty for violation of BCPUDs drug-free policy is compulsory enrollment in an approved substance abuse program and, depending on the circumstances, employment may be terminated and/or legal action may ensue.

     IT IS HEREBY CERTIFIED that this resolution was duly introduced and adopted by the Board of Directors of the Bolinas Community Public Utility District this 20th day of June, 2001, by the following vote:
